Terms of Service

AussieWebCompany · aussiewebcompany.com Last updated: 15 October 2026

These Terms of Service (“terms”) apply to your use of aussiewebcompany.com and to the services you buy from AussieWebCompany. Please read them, together with our Privacy Policy, Refund & Cancellation Policy and Delivery & Fulfilment Policy, before you accept a quote or pay.

1. Who we are

AussieWebCompany is a web design studio building websites, Shopify stores and brand identities for Australian businesses. AussieWebCompany is a brand operated by TOBODIGI LLC, a Maryland (USA) limited liability company, 7570 South Arbory Ln, Laurel, MD 20707, USA. When you buy from AussieWebCompany, your contract is with TOBODIGI LLC. Our brand office is at 202/37 Barrack St, Perth WA 6000, Australia.

2. Enquiries, quotes and your agreement

Submitting a form, chatting with us or booking a call is an enquiry, not an order. A project begins only when you accept our written quote or proposal and pay the amount due. The quote or proposal sets out the deliverables, price, payment schedule, timeline and revisions for your project. If it conflicts with these terms, the quote or proposal wins for that project. Any rights that cannot be excluded by law still apply.

3. Prices and payment

Prices on our website are starting project fees in Australian dollars: Websites — Launch (up to 5 pages) from A$249, Business from A$699, Growth from A$1,299; Shopify — First Store from A$425, Store Builder from A$799, Brand Store from A$1,399; Branding — Logo from A$149, Identity from A$349, Brand Kit from A$549. Your written quote or project agreement confirms the total, any applicable GST, inclusions, exclusions and payment schedule. No payment is taken through this website: we send a secure invoice or payment link after you accept the quote.

We accept payment through Stripe or PayPal and, where agreed, Payoneer, using secure payment links or invoices. We will never ask for card details by email, chat or WhatsApp. Payments are charged in Australian dollars (AUD) and processed by TOBODIGI LLC, a company based in the United States, through Stripe or PayPal and, where agreed, Payoneer. Because the merchant is located overseas, your bank or card issuer may treat the payment as an international transaction and charge a foreign transaction fee, even though the amount is in AUD. These fees are set by your bank, not by us. Your statement may show “TOBODIGI LLC” or “AussieWebCompany” as the merchant. Unless your proposal says otherwise, invoices are due on receipt. If a milestone payment is overdue, we may pause work until it is paid. Prices on our website may change, but a change does not affect a quote you have already accepted.

4. Your responsibilities

You agree to give us accurate information, a complete brief, content and timely feedback, and to have the rights to everything you supply (text, images, logos, trade marks, data and code). You are responsible for checking and approving deliverables, including spelling, facts and legal compliance of your content, before you publish or print them.

5. Revisions, changes and timelines

Revisions, timelines and delivery methods are described in our Delivery & Fulfilment Policy and in your quote or proposal. Work outside the agreed scope, including new concepts, new features or a substantially changed brief, will be quoted before we start it. Timelines depend on your feedback, content and access, and on third-party platforms.

6. Cancellations and refunds

Cancellations and refunds are covered by our Refund & Cancellation Policy, which forms part of these terms. Nothing in these terms or that policy excludes your rights under the Australian Consumer Law.

7. Ownership and licences

Once you have paid in full, we transfer to you the rights in the final, approved custom deliverables we create for you, as described in your quote or proposal. Until full payment, we keep those rights and you may not use the work. Preliminary concepts, rejected alternatives and working files are not included unless your proposal says so. Third-party materials (such as fonts, stock images, themes, plugins, software libraries or AI/platform outputs) stay subject to their own licence terms. Where a paid licence is needed, we will tell you, and it is not included unless stated. You keep all rights in the materials you supply to us.

8. Portfolio use

Unless you ask us not to, or we have agreed to confidentiality, we may display completed work in our portfolio and marketing after it has been made public by you. We will never disclose confidential business information.

9. Confidentiality

We keep information you share with us for a project confidential and use it only to deliver our services, except where disclosure is required by law. We are happy to sign a reasonable non-disclosure agreement on request.

10. Acceptable use

We do not accept projects involving unlawful activity, content that infringes the rights of others, misleading or deceptive claims, hate speech, harassment, sexually explicit content, weapons, illegal drugs, gambling, or financial or health claims we believe are misleading. We may decline or stop a project that breaches this section. If we do, we refund any amount paid for work not yet performed. When using our website, you must not attempt unauthorised access, disrupt its operation or copy content that belongs to us or others.

11. No guarantee of results

We commit to delivering the agreed deliverables with reasonable care and skill. We do not guarantee business outcomes such as sales, revenue, leads, traffic, search rankings, advertising performance, social media growth, platform approval, or that any trade mark will be registered. Any examples, portfolio pieces or estimates are illustrations, not promises.

12. Launch and ongoing support

Launch, migration, training, maintenance, backups, security monitoring and ongoing support are included only to the extent specified in your agreement. Third-party platforms (such as Shopify or WordPress plugins) can change features, pricing and availability.

13. Your content and access

You are responsible for supplying accurate, approved content and for having permission to use the images, trade marks, text and other materials you provide. Share account access only through an agreed secure method, and never send passwords or card details through our enquiry forms.

14. Third-party platforms and services

Our work may rely on third-party platforms such as Shopify, WordPress, hosting providers, domain registrars and app or plugin developers. These platforms are governed by their own terms and may change features, pricing, review processes or availability at any time. We are not responsible for their acts or omissions. Third-party costs (domains, hosting, Shopify subscriptions, paid themes, apps and plugins, third-party licences, advertising spend and specialist production) are your responsibility unless your proposal expressly includes them.

15. Warranties and disclaimers

Except as stated in these terms, in your proposal, or as required by law (including the consumer guarantees under the Australian Consumer Law), our website and services are provided “as is”, and we disclaim implied warranties to the extent the law allows.

16. Limitation of liability

To the extent the law allows, TOBODIGI LLC is not liable for indirect, incidental or consequential loss, or loss of profits, revenue, data or goodwill, and our total liability for any claim relating to a project is limited to the amount you paid us for that project. This limit does not apply to liability that cannot be limited under the Australian Consumer Law. Where the law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.

17. Indemnity

You agree to cover our reasonable losses arising from a third-party claim that materials you supplied, or your use of the deliverables in breach of these terms or the law, infringe someone’s rights or break the law.

18. Termination

Either of us may end a project by written notice if the other materially breaches these terms and does not fix the breach within 10 business days of notice. You may cancel at any time under our Refund & Cancellation Policy. On termination, you pay for work completed up to that date, and we deliver the work you have paid for.

19. Resolving concerns and governing law

If you have a concern, please contact us first at info@aussiewebcompany.com so we can try to resolve it. We aim to respond within 2 business days. These terms are governed by the laws of the State of Maryland, USA. If you are a consumer in Australia, this choice of law does not remove the protection of the Australian Consumer Law or other Australian laws that apply to you, and you may bring proceedings in Australia. Nothing in these terms excludes, restricts or modifies any right or remedy, including the consumer guarantees under the Australian Consumer Law, that cannot lawfully be excluded.

20. Changes to these terms

We may update these terms for future use of our website and future projects. Changes do not affect a project you have already agreed to, unless you agree in writing.
